The following terms and conditions apply to any design project that Jelly Design Studio, LLC is hired for. When you make a deposit or any payment for any design project you (the client) are agreeing to these terms and conditions. Failure to comply with the terms and conditions may result in termination of our services. Communication and Business Hours:
The main form of communication for any design project will be via email. Communication via phone/video chat is reserved for special cases and must be scheduled in advance.

Emails will be answered Monday through Friday EST (except on holidays). You may hear from me on weekends, but please keep in mind that Jelly Design Studio, LLC does not always operate during the weekends. I will always do my best to reply to any email within 2 business days.

Payments & Refunds:
Payments must be made via PayPal or check. Please write checks out to Jelly Design Studio. Mailing address for check will be provided if necessary.

A non-refundable 50% deposit is required prior to beginning your design project. This deposit reserves your space into my project schedule to allow for the appropriate time to focus on your design project.

Once the final design has been approved by you (the client) I will send you the invoice for the remaining balance. Please keep in mind that the final balance must be paid in full to install your new design and turn in any files to you.

All deposits made to Jelly Design Studio, LLC are non-refundable.

Design Schedule & Turnaround Time:
Typically design projects are estimated to be completed in 3 to 4 weeks, however we am not responsible if any design project goes over this timeframe based on the number of edits or revisions. Prompt communication from both parties (Jelly Design Studio, LLC and the client) is crucial to get any project completed within the time estimated.

If we do not hear form you (the client) within one calendar month of our last email, your design project will be placed on hold and moved to the back of the queue. Design project will be resumed after hearing back from you.

Once a proof has been submitted we will allow for three reasonable design revisions. Additional revisions or changes that were not included in the original invoice will be subject to a revision fee. When final design has been approved an invoice for the final balance will be sent to you. Final balance must be paid in full to install your new design and turn in any files to you.

When the new design has been approved and installed the design project is considered complete. You have 3 business days to email me with basic questions about your new blog or website design. Any update or revisions that you request once project is complete will be subject to an additional fee unless it is an error on my part.

It is always suggested to back up your template/theme if making any changes. Jelly Design Studio, LLC is not liable to any changes you make to your blog/site design.

Mood boards, logo proofs, and design proofs not used on your final design are the property of Jelly Design Studio, LLC.

Browser Testing:
We test our work in current versions of major desktop browsers including those made by Apple (Safari), Google (Chrome) Mozilla Firefox, and Opera. We won’t test in other older browsers unless you specify otherwise.

Design Elements & Files:
Jelly Design Studio, LLC is not liable for any photos, images, copy/content, or design elements provided by the client. Custom and pre-made templates for any platform (WordPres.org, WordPress.com, Blogger, etc.) are created for single use. You are not allowed to resell, trade, distribute, or install on another site.

Jelly Design Studio, LLC does save all your design files in case of future design updates but we are not responsible if any of your files are lost or damaged. Please let us know if you would like your master files and we can send them to you once we are done with your design project. We are not liable for file storage.

Abandonment of Project:
Jelly Design Studio LLC will consider any design project abandoned by the client if we have not received the required feedback, content, or any form of communication within 30 days. All incomplete projects will be property of Jelly Design Studio LLC and any deposit made is non-refundable.

If any client would like to restart the abandoned project, client will be subject to a 25% restart fee based on the full total that was originally discussed. The client’s project will then be rescheduled and will start when Jelly Design Studio has an upcoming availability.

Privacy & Access:
Your email address and any other private information provided to Jelly Design Studio, LLC will only be used for the design project. Private information will not be distributed to any third-party.

Any access granted for design and installation process will only be used throughout the span of our time working together on your design project.

Additional Terms:
Jelly Design Studio, LLC does not provide Hosting services. The client is responsible for choosing, paying for, and maintaining any required Hosting solutions and associated services. As a courtesy, Jelly Design Studio, LLC may offer suggestions, however, Jelly Design Studio, LLC is NOT responsible for down time, poor performance, or loss of data caused by the Hosting Provider. If any functionality issues do arise you will have to contact your site host/domain provider for further assistance.

We can’t guarantee that our work will be error-free and so we can’t be liable to you or any third-party for damages, including lost profits, SEO, page view, any lost of content or traffic, lost savings or other incidental, consequential or special damages, even if you’ve advised us of them. Finally, if any provision of this contract shall be unlawful, void, or for any reason unenforceable, then that provision shall be deemed severable from this contract and shall not affect the validity and enforceability of any remaining provisions.
